Terms of Service

These Terms of Service apply to Branchy, a mobile game developed and published by Studio Tree. Branchy is provided as a free game and may be supported by advertising. By downloading, accessing, or using Branchy on Google Play, iOS, or another supported platform, you agree to these Terms.

1. License and acceptable use

Studio Tree grants you a personal, limited, non-exclusive, non-transferable, and revocable license to download and use Branchy on devices that you own or control, subject to these Terms of Service.

You may not copy, modify, translate, reverse engineer, decompile, disassemble, or create derivative works from Branchy or any part of it, except where applicable law expressly permits those activities. All trademarks, copyrights, database rights, and other intellectual property rights related to Branchy remain with Studio Tree and its licensors.

You agree not to use Branchy for an unlawful purpose, infringe the rights of another person, upload or transmit malicious code, interfere with the operation or security of the game, or bypass measures intended to prevent or restrict access to Branchy.

2. Service changes and availability

Studio Tree works to keep Branchy useful and available, but we may modify, suspend, or discontinue the game or any feature at any time, temporarily or permanently, with or without notice.

We do not guarantee that Branchy will always be available, error-free, or compatible with every device or operating system. You agree to install updates when they are offered so that you can continue using the current version of the game.

3. Connectivity and device responsibility

Some features of Branchy may require an active internet connection. Studio Tree is not responsible for reduced functionality caused by a lack of connectivity, an exhausted data allowance, or network restrictions.

If you use Branchy outside a Wi-Fi area, your mobile provider's terms and charges, including roaming charges, may apply. You are responsible for keeping your device charged, operational, and compatible with the game.

4. Third-party services

Branchy may use third-party services that help us operate, analyze, secure, advertise, and improve the game. Those services may have their own terms and privacy policies, and your use of them may be governed by those terms.

Third-party services may include app store platforms, hosting providers, analytics tools, crash reporting tools, and advertising networks such as Google AdMob, Google Analytics for Firebase, or Firebase Crashlytics, if included in the version of Branchy you use. Studio Tree does not guarantee the availability, accuracy, or continued operation of features that depend on a third party.

Apple Inc., Google LLC, and other platform providers are not responsible for maintaining or supporting Branchy or for addressing claims related to the game.

5. Privacy and data

Branchy may store and process information as described in the Branchy App Privacy Policy. By using Branchy, you consent to the collection and use of information consistent with that policy and applicable law.

6. Disclaimers

To the maximum extent permitted by law, Branchy is provided as is and as available, without warranties of any kind, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Studio Tree does not warrant that Branchy will meet your requirements, operate without interruption, remain secure, or be free of errors or harmful components.

7. Limitation of liability

To the fullest extent permitted by law, Studio Tree will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to Branchy. This includes loss of data, loss of profits, loss of goodwill, service interruption, device damage, or the cost of substitute services.

To the extent liability cannot be excluded, Studio Tree's total liability arising from or relating to Branchy or these Terms will not exceed the amount you paid, if any, to use Branchy during the twelve months before the event giving rise to the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless Studio Tree, its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of Branchy, your violation of these Terms, or your violation of any law or third-party right.

9. Termination

These Terms remain in effect until terminated by you or Studio Tree. Your rights under these Terms end automatically if you fail to comply with any provision. Upon termination, you must stop using Branchy and delete it from your devices.

Studio Tree may suspend or terminate access to Branchy at any time, with or without notice, including for maintenance, security, legal, or compliance reasons.

10. Governing law and disputes

These Terms are governed by applicable law, without regard to conflict of law rules. Any dispute arising from Branchy or these Terms will be handled by a court with appropriate jurisdiction over Studio Tree and the dispute, unless applicable law requires a different forum or process.

11. Changes to these Terms

Studio Tree may update these Terms from time to time. We will update the effective date at the top of this page when changes are made. If changes are material, we may provide additional notice, such as an in-game notice or an app store update description.

Your continued use of Branchy after updated Terms become effective means that you accept the updated Terms.

12. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

These Terms constitute the entire agreement between you and Studio Tree regarding Branchy and supersede prior understandings about the game. A failure to enforce any right or provision is not a waiver of that right or provision.
